1. Overview

Welcome to KiwiRoofTech. Our website, https://kiwirooftech.com, provides information about and offers for sale roofing products, including our KiwiKricket range and associated accessories.

By accessing our website or placing an order, you agree to these Terms of Service, subject to your rights under applicable consumer laws.

Throughout these terms, “we”, “us” and “our” refer to KiwiRoofTech.

Our online store is powered by Shopify.

2. Products and Specifications

KiwiRoofTech supplies roofing water-diversion products, including KiwiKricket PVC and Aluminium models.

Our standard KiwiKricket range includes widths of 400 mm, 600 mm, 800 mm, 1000 mm and 1200 mm.

We aim to provide accurate product descriptions, dimensions, images, material specifications and installation information.

Customers should review product specifications carefully before purchasing.

Product images are provided for illustration purposes. Minor variations in appearance or finish may occur, provided products meet their descriptions and applicable consumer guarantees.

3. Product Suitability and Installation

KiwiKricket products are designed to assist with diverting rainwater around suitable roof penetrations, including skylights and chimneys.

Customers and installers are responsible for assessing the suitability of a product for the intended roofing application.

Installation should follow the supplied instructions, relevant building requirements and appropriate roofing practices.

We recommend professional installation where the customer does not have the necessary roofing knowledge or experience.

KiwiRoofTech does not guarantee that a product will be suitable for every roof design, material or installation condition.

Nothing in this section excludes liability arising from defective products, inadequate instructions, misleading representations or other matters for which liability cannot lawfully be excluded.

4. Pricing and Payments

Unless otherwise stated, prices displayed on our website are in New Zealand dollars (NZD).

Any applicable taxes and delivery charges will be displayed or calculated during checkout.

We reserve the right to correct genuine pricing errors and update prices for future orders.

If a pricing error affects an order, we will contact the customer before proceeding and offer an appropriate resolution, including a refund where required.

Payments are processed through the payment methods available at checkout.

5. Orders and Availability

Submitting an order does not necessarily guarantee that the product is immediately available for dispatch.

Some products may be manufactured or prepared to order.

If we cannot fulfil an order within an agreed or reasonable timeframe, we will contact the customer to discuss available options, including cancellation and refund where appropriate.

We reserve the right to decline or cancel orders where there is a legitimate reason to do so, subject to applicable law.

6. Shipping and Delivery

KiwiRoofTech dispatches orders from Rotorua, New Zealand, and offers delivery to eligible addresses in New Zealand and Australia.

Shipping costs and available delivery methods are displayed at checkout or provided through a separate freight quotation where necessary.

Delivery timeframes may vary depending on manufacturing requirements, courier availability and destination.

7. Returns, Refunds and Consumer Rights

KiwiRoofTech does not offer voluntary returns or refunds for change of mind.

This does not affect customers' rights under applicable consumer protection laws.

Where the New Zealand Consumer Guarantees Act 1993 applies, customers may be entitled to remedies for products that fail to meet statutory guarantees.

Australian customers may also have rights under the Australian Consumer Law.

Nothing in these Terms of Service excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded.

8. Custom and Made-to-Order Products

Custom-sized, colour-matched or specially manufactured products may require additional production time.

Customers should confirm specifications before placing custom orders.

Custom and made-to-order products are not eligible for voluntary change-of-mind returns.

Applicable statutory consumer rights remain unaffected.

9. Product Use and Liability

Products must be used and installed in a manner consistent with their intended purpose and supplied instructions.

To the extent permitted by law, KiwiRoofTech is not responsible for damage caused solely by misuse, unauthorised modification or incorrect installation unrelated to a defect or failure on our part.

We do not exclude or limit liability where doing so would be unlawful, including liability arising under applicable consumer protection legislation.

10. Trial Partner Programme

Participation in the KiwiRoofTech Trial Partner Programme may be subject to additional conditions communicated to applicants.

Trial pricing, product availability and participation are subject to confirmation by KiwiRoofTech.

Submitting an application does not guarantee acceptance into the programme.

Any additional testing, feedback or promotional arrangements will be agreed separately with participating businesses.

11. Intellectual Property

The KiwiRoofTech and KiwiKricket names, branding, original product designs, website content, images and other materials may be protected by applicable intellectual property laws.

Customers may not reproduce or commercially exploit protected materials without permission, except where permitted by law.

Purchasing a product does not transfer ownership of any associated intellectual property rights.

12. Website Use

Users must not misuse our website, interfere with its operation, attempt unauthorised access or engage in unlawful activities through the store.

We may take reasonable steps to protect the security and operation of our website.
